Article 1 β Definitions
In these general terms and conditions, the following definitions apply:
Cooling-off period: the period within which the consumer may exercise their right of withdrawal.
Consumer: the natural person who is not acting in the exercise of a profession or business and who enters into a distance contract with the entrepreneur.
Day: calendar day.
Continuing performance contract: a distance contract relating to a series of products and/or services, for which the obligation of delivery and/or purchase is spread over time.
Durable data carrier: any medium that enables the consumer or entrepreneur to store information addressed personally to them in a way that allows future consultation for a period appropriate to the purpose of the information and which allows unchanged reproduction of the stored information.
Right of withdrawal: the option of the consumer to withdraw from the distance contract within the cooling-off period.
Entrepreneur: the natural or legal person who offers products and/or services to consumers at a distance.
Distance contract: a contract concluded between the entrepreneur and the consumer in the framework of an organized system for distance selling of products and/or services, whereby up to the conclusion of the contract exclusive use is made of one or more means of distance communication.
Means of distance communication: a means that can be used for concluding a contract without the consumer and the entrepreneur being together in the same place at the same time.
General Terms and Conditions: these general terms and conditions of the retailer.

Article 3 β Scope
These general terms and conditions apply to every offer made by the entrepreneur and to every distance contract concluded between the entrepreneur and the consumer.
Before the contract is concluded, the consumer will be asked to read the general terms and conditions. If this is not reasonably possible, it will be indicated how the general terms and conditions can be consulted at the entrepreneurβs premises and that they will be sent free of charge to the consumer as soon as possible upon request.
If the contract is concluded electronically, the text of these general terms and conditions may be made available to the consumer electronically in such a way that it can easily be stored by the consumer on a durable data carrier. If this is not possible, it will be indicated where the general terms and conditions can be viewed electronically and that they will be sent electronically or otherwise free of charge at the consumerβs request.
If specific product or service conditions apply in addition to these general terms and conditions, these provisions shall also apply. In case of conflicting conditions, the consumer may always invoke the provision most favorable to them.
If one or more provisions of these general terms and conditions are void or annulled, the remaining provisions shall remain in force, and a substitute provision shall apply that reflects as closely as possible the intent of the original provisions.
Where these general terms and conditions do not provide, situations must be assessed βin the spiritβ of these terms and conditions.
Any ambiguities regarding the interpretation of one or more provisions must also be interpreted βin the spiritβ of these general terms and conditions.
Article 4 β The Offer
If an offer is subject to a limited period of validity or made under conditions, this must be explicitly stated.
The offer is non-binding. Victoria&Elise Vancouver reserves the right to change or amend the offer.
The offer contains a complete and accurate description of the products and/or services offered. The description must be sufficiently detailed to enable the consumer to make a proper assessment of the offer. If Victoria&Elise Vancouver uses images, these must be a true representation of the products and/or services offered. Obvious mistakes or obvious errors in the offer do not bind Victoria&Elise Vancouver.
Images, specifications, and descriptions are for illustration purposes only and do not give rise to any rights or claims. Differences in color may occur between product images and the actual products.
Every offer must contain clear information so that the consumer knows which rights and obligations are attached to accepting the offer. These include, among others:

Price (excluding customs duties and import VAT, which are payable by the customer).

Any shipping costs.

How the contract will be concluded and which steps are necessary.

Possible application of the right of withdrawal.

Methods of payment, delivery, and performance.

Validity of the offer or the period during which the price is guaranteed.

Communication costs if they differ from the basic rate.

Whether the contract will be archived and whether the consumer can access it.

How the consumer can check and, if necessary, correct the information provided.

The languages in which, besides English, the contract may be concluded.

The duration of the contract if it concerns continuous performance.

Available sizes, colors, and materials.
Article 5 β The Agreement
The agreement is concluded at the moment the consumer accepts the offer and meets the corresponding conditions.
If the consumer accepts the offer electronically, Victoria&Elise Vancouver shall immediately confirm receipt of acceptance. Until this receipt has been confirmed, the consumer may dissolve the contract.
